What is "consent"?
Consensual sex between a young man and his underaged partner is NOT the same as statutory rape. This was the finding of the Shah Alam Sessions court in the case of a 21-year-old man who admitted "raping" a mentally-retarded underaged girl.
...
"It's about time these cases are segregated from those involving more mature men who induce (or force) underaged girls into sexual acts. This is a problem of morality," she [judge Suraya Othman] said.
But even if an underaged girl consents, does she know what she's consenting to? Does she realise the implications of her actions? Is she in a position to make that kind of decision for herself?
The report says the girl in question was 15 years old at the time. Not only was she underaged, she is also mentally-challenged. Isn't she even LESS able to make that kind of decision for herself in such circumstances?
If a girl consents to sexual intercourse without fully understanding what she is consenting to, can it still be called "consent"?
